D’Emilia Law is representing a man charged with two counts of assault for throwing an obscene object during a New York Liberty and Dallas Wings basketball game at the Barclays Center in August. The 32 year old Ohio man faces two felony charges of assault for allegedly striking a 12-year-old girl with the object following the prosecution’s review of surveillance footage. However, we assert that the “video evidence” is insubstantial and fails to reveal that anyone was actually struck.
“[Our client] intends to vigorously fight these embellished and exaggerated charges,” firm founder Paul D’Emilia told the New York Post.
Our client, a married father of six children with no criminal record, voluntarily turned himself in to the police when he learned of the arrest warrant for the felony charges. He was released on his own recognizance during his arraignment.
“I think eventually [the charges are] going to be dropped. I can’t imagine why they charged, for example, the felony charge, attempted assault in the second degree,” D’Emilia, a former prosecutor, said in a statement reported by WDTN News. “That’s a serious charge for when you’re intentionally trying to hurt somebody.”
While this is the sixth disturbance of this type at a basketball game this year, D’Emilia theorizes that these incidents are a marketing ploy to promote a cryptocurrency meme coin. “[Our client] does not regularly attend WNBA games, he is a casual fan, and he is not involved in any of these or prior incidents,” D’Emilia said to the Post.
Our client is due back in court in December, where we will aggressively fight the charges against him.
